In light of the global health emergency caused by COVID-19, Royal Decree-Law 8/2020, of 17 March, on urgent extraordinary measures to confront the economic and social impact of COVID-19, and Royal Decree-Law 11/2020, of 31 March, adopting urgent complementary measures in the social and economic sphere to confront COVID-19, were published in the Official State Gazette, detailing the processes for requesting a moratorium and the documentation required to accredit the situation of economic vulnerability, and / or in the sectorial agreement on the deferral of financing operations for customers of associated entities affected by the coronavirus crisis to which CaixaBank has acceded. These regulations allow particularly vulnerable groups the possibility of deferring, for a period of three months which may be extended, loans or credits with mortgage guarantees for the acquisition of:
- Their habitual residence
- Properties connected to the economic activity of entrepreneurs and professionals1
- A residential property other than their habitual residence which they are letting and have received no rent for since the entry into force of the state of alarm or up to one month after the end of the state of alarm
In order to support and help families that have been affected by the crisis to overcome this difficult situation, an additional and complementary sectoral initiative to the measures announced by the Government so far has been launched to offer, in some of these cases, a delay of up to twelve months in the repayment of capital.
Workers who become unemployed; entrepreneurs/professionals who have suffered a substantial drop in income or turnover of more than 40%; and individuals who own and let a mortgaged property. Provided that all of the
- The total monthly income of the family unit2 in the month prior to the request for the moratorium did not exceed three times the monthly IPREM (€1,613.52). This figure may be extended if there are children or persons over 65 years of age dependent on the family unit, or members of the family unit with an intellectual disability of 33% or more, or a sensory disability of 65% or more.
- The total of the mortgage payments plus basic expenses and utilities3 equals 35% or more of the net income of the family unit.
- That, as a result of the health emergency, the mortgage burden on family income has increased by more than 30%.
- And that, as a result of the health emergency, the family unit has suffered a significant alteration in its economic circumstances when the effort represented by the total mortgage payments on the family income has been multiplied by a factor of 1.3 or more.following conditions are met:
- LEGAL MORATORIUM: This is a moratorium on capital and interest for three months with the possibility of being extended.
- SECTORAL MORATORIUM: This is a capital moratorium for a period of up to twelve months. If the requirements to benefit from the legal moratorium are met, both measures will be compatible, but together they cannot exceed twelve months.
- Applications can be made up to 15 days after the end of the current Royal Decree-Law 8/2020.
In the case of unemployed salaried workers:
- Certificate of unemployment.
- A responsible declaration by the debtor(s) regarding the fulfilment of the requirements to be considered as having insufficient economic resources.
In the case of entrepreneurs or professionals/self-employed workers:
- A responsible declaration by the debtor(s) regarding the fulfilment of the requirements to be considered as having insufficient economic resources.
- In the case of termination of activity, the certificate issued by the Spanish Tax Agency or the competent body of the Autonomous Community.
If the monthly income of the Family Unit exceeds 3 x IPREM (€1,613.52): the Family Book, a document accrediting civil partnership, and/or a census certificate specifying the persons registered in the residence at the time of submission of the accrediting documents and the previous six months.
If applicable, declaration of disability, dependence or permanent incapacity for work, to validate the increased allowance corresponding to the condition.
Other documentation:
- Land Registry short report stating the properties owned by all members of the family unit.
- Deeds of sale of the habitual residence, the rented property, or the property connected to the economic activity, and the deeds of the mortgage loan or loans, if requesting a moratorium on the mortgage debt.
- If applying for a moratorium on the mortgage debt for a loan constituted on a let property, the rental contract must be provided.

- Once the request is made and the documentation is received, the institution must respond, and, if the request is considered valid, apply the moratorium on the payment within fifteen days.
